These terms and conditions apply to the sale of any course. Please read these Terms and Conditions carefully before purchasing a course.

1. Ordering Procedures

1.1 In order to purchase a course via the website you must register for an online KPMG Learning Academy account via the website.
1.2 When ordering via postal application, email or telephone you do not need to be registered online.
1.3 When you place an order for a course you are offering to purchase that course on these Terms and Conditions. KPMG Learning reserves the rights to decline or cancel your order, or any part of your order.
1.4 Following receipt by KPMG Learning of your order for a course you will receive an email confirming that your order has been received.
1.5 KPMG Learning Academy reserves the right to withdraw at any time courses advertised for sale on the website or brochure.

2. Payment Terms

2.1 The Fee for any course at any given time will be displayed on the Website and the Brochure. Fees are quoted in Euros are exclusive of VAT and exclusive of any additional charges.
2.2 The Fee includes the tuition, study materials and revision classes if applicable. The fee excludes any additional charges which shall be paid by you on and when they are due. Where, in the case of ACCA, KPMG Learning Academy is required to collect applicable examinations fees on behalf of a relevant professional body, these will be paid by KPMG Learning Academy on your behalf to that professional body.
2.3 KPMG Learning Academy may issue notices with respect to discounts when applying for ACCA courses. The notice will include a deadline of applications and any cancellations will be dealt with according to Clause 3: Cancellation Rights

3. Cancellation Rights

3.1 You may cancel your purchase of a course within 14 days from which the contract is concluded subject that the course start date is not less than 14 days of cancellation.
3.2 You must inform KPMG Learning Academy of your decision to cancel by emailing KPMG Learning Academy or by sending a cancellation form which is attached to these terms.
3.3 If you cancel your course you must return any study material you have received from KPMG Learning Academy without undue delay and not later that 5 days after you inform KPMG Learning Academy of the cancellation.
3.4 KPMG Learning Academy reserves the right to withhold payment or all of your fee until the training materials have been returned.
3.5 On cancellation you will entitled to a full refund of fees if such a cancellation is done within the cancellation period.
3.6 Your order of a course is personal to you and you will not be permitted to transfer your enrolment on a course to any other student.

4. Course Deferral

4.1 An enrolment can be deferred for one exam sitting and should be received at least 1 week prior to the commencement date.
4.2 If you defer your course you must return any study material you have received from KPMG Learning Academy without undue delay and not later that 5 days after you inform KPMG Learning Academy of the cancellation.

5. Study materials

5.1 Where hard copies study material accompany the classroom course, these study materials will be made available to you at the relevant premise where the classroom course is to take place.
5.2 Where hard copy of the study material accompany the online course these must be collected from our offices.
5.3 KPMG Learning Academy must be notified of any queries, complaints or incorrect course material with five days of you receiving the study material.

6. Classroom Training, course description and training materials

6.1 Please see the description of the course on the Website and/or in the brochure for detail of the content of the available courses.
6.2 Except as set out in the course description of the course on the Website and/or brochure, no additional study material and/or tuition will be provided by KPMG Learning Academy.
6.3 KPMG Learning Academy operates a zero tolerance policy in relation to inappropriate behavior of students. Unfair and dishonest practices including but not limited to cheating will not be tolerated under any circumstances.
6.4 Course participants must comply with all health and safety rules and regulations and any other reasonable security requirements that apply at the premises at which classroom courses are provided.
6.5 KPMG Learning Academy shall provide tutors to deliver training courses as it deems fit and KPMG Learning Academy shall be entitled to substitute any tutor with any other person who, in KPMG Learning Academy’s sole discretion, it deems suitable qualified to present the relevant training.
6.6 Students must sign an attendance register for each time they attend a course as required by the tutor.
6.7 The students’ personal possessions are their sole responsibility and KPMG Learning Academy accepts no responsibility for anything lost from the training venue.

7. Online Training, course description and training materials

7.1 Please see the description of the course on the Website and/or in the brochure for detail of the content of the available courses.
7.2 Except as set out in the course description of the course on the Website and/or brochure, no additional study material and/or tuition other than that specified by KPMG Learning Academy will be provided.
7.3 Upon receipt of a confirmation email you will be notified when you have Access to the online course purchased and for the length of time such access will be made available to you.
7.4 The receipt of an online course is personal to you and you may not transfer your rights to access such course to any other person.
7.5 Please note that it is your responsibly to check that the computer you plan to use to access your live course delivery and study materials is compatible with the minimum specifications requirements as specified in My Kaplan.

8. ACCA Results Service

8.1 The ACCA Result service is the mechanism of gathering student data to allow for the analysis of pass rates. In turn, students’ details will be shared with ACCA in order to gather quarterly pass rates information through the ACCA Results Service.

9. Warranties

9.1 KPMG Learning Academy will provide the study materials in accordance with the course description which is set out on the website.
9.2 KPMG Learning Academy expect students to verify that the course and study materials in question will meet your needs.
9.3 KPMG Learning Academy does not guarantee to you that the study material will be error free.
9.4 KPMG Learning Academy does not make any commitment that the online courses will be compatible with your software or hardware.

10. Complaints

10.1 If you are not satisfied with the way you have been treated you may explain the problems to the member of staff with whom you are dealing.
10.2 Support staff will direct you to the appropriate person who can deal with your complaint. If your complaint is not then resolved informally and you wish to make a formal complaint you should ask to speak to the Director of Studies.
10.3 Complaints may be done by letter, telephone, email or in person. All complaints at this level will be dealt with within five working days.
10.4 If you have exhausted both your learning provider complaint’s process and ACCA’s, you can escalate to the appropriate regulator. Details of which can be found on the ACCA website at the following link: https://www.accaglobal.com/gb/en/footertoolbar/contact-us/connect/unhappy.html 
10.5 Compliments are also welcome as they help us know what we are doing well. So even if you have no complaint, we would still like to hear your feedback and comments.
