By registering for and enrolling in an ACCA course through KPMG Learning Academy (License No. 2017-010), you (the student) acknowledge and agree to be bound by these Terms and Conditions. This agreement incorporates the provisions of both the Course Terms and Conditions and the ACCA Student Agreement.

The agreement becomes effective upon successful completion of the registration and payment process. By completing enrolment, both you and KPMG Learning Academy agree to uphold the terms outlined in this agreement.

1.      Ordering Procedures

1.1.  To purchase a course via the website, you must register for an online KPMG Learning Academy account.

1.2.  By placing an order, you are offering to purchase a course in accordance with these Terms and Conditions. KPMG Learning Academy reserves the right to decline or cancel your order, or any part of your order.

1.3.  Following receipt by KPMG Learning Academy of your order for a course you will receive an email confirming that your order has been received.

1.4.  KPMG Learning Academy reserves the right to withdraw at any time courses advertised for sale on the website or brochure.

2.      Payment Terms

2.1.  Course fees are listed in Euros on the website and brochure, exclusive of VAT and any other applicable charges.

2.2.  Fees include tuition, study materials, and revision sessions (where applicable). Additional charges are the responsibility of the student.

2.3.  Discount notifications for ACCA courses may include application deadlines and cancellation clauses.

3.      Cancellation and Refund Procedures

3.1.  You may cancel your course within 14 business days of booking, provided the course does not start within that window.

3.2.  You must inform KPMG Learning Academy of your decision to cancel by emailing KPMG Learning Academy on kla@kpmg.com.mt.

3.3.  If you cancel your course, you must return any study material you have received from KPMG Learning Academy without undue delay and not later than 5 business days after you inform KPMG Learning Academy of the cancellation. KPMG Learning Academy reserves the right to withhold payment or all of your fee until the training materials have been returned.

3.4.  On cancellation, a credit to your account will be raised if such a cancellation is done within the cancellation period. Refunds will be granted at KPMG Learning Academy’s discretion and are subject to a cancellation fee.

3.5.  Your order of a course is personal to you, and you will not be permitted to transfer your enrolment on a course to any other student.

3.6.  The institution is obligated to refund tuition fees and additional reasonable expenses under the following scenarios:

3.6.1.     Course cancellation

3.6.2.     Delayed start or early termination of the programme

3.6.3.     Revocation of licence by the Authority

Note: Students withdrawing before such events are not eligible for refunds under these clauses.

4.      Course Deferral

4.1.  A course may be deferred for one exam sitting if the request is received at least one week before the start date.

4.2.  If you defer your course you must return any study material you have received from KPMG Learning Academy without undue delay and not later than five (5) days after you inform KPMG Learning Academy of the cancellation.

5.      Student Responsibilities

5.1.  The student agrees to:

5.1.1.     Provide accurate academic and personal data at registration and update the institution of any changes.

5.1.2.     Fulfil academic obligations (attendance, coursework, participation, and assessments).

5.1.3.     Follow the institution’s policies, regulations, and student conduct guidelines.

5.1.4.     Notify the institution of any address/contact changes post-study.

5.2.  Default by the student (e.g., failure to start course, late payment, visa breaches) will render the student ineligible for refunds.

6.      Study Materials

6.1.  The course fee includes access to digital copies of the Integrated Workbook, Study Text, and Exam Kit. Learners may choose to receive physical copies of the study materials—including the Integrated Workbook, Study Text, Exam Kit, and Pocket Notes—delivered to their personal address for an additional fee. Shipping charges will be calculated and displayed at checkout.

6.2.  Import duties, taxes, or customs fees applicable to the shipment of physical materials are the sole responsibility of the recipient. These charges are determined by the destination country’s regulations and may be up to 20% of the total value of the study materials. Delivery may be withheld by the courier until such fees are paid in full.

6.3.  KPMG Learning Academy must be notified of any queries, complaints or incorrect course material with five (5) days of you receiving the study material.

7.      Course Content and Training

7.1.  Students can access the description of the course on the Website and/or in the brochure for detail of the content of the available courses.

7.2.  Except as set out in the course description of the course on the Website and/or brochure, no additional study material and/or tuition will be provided by KPMG Learning Academy.

7.3.  KPMG Learning Academy operates a zero-tolerance policy in relation to inappropriate behaviour of students. Unfair and dishonest practices including but not limited to cheating will not be tolerated under any circumstances.

7.4.  Course participants must comply with all health and safety rules and regulations and any other reasonable security requirements that apply at the premises at which classroom courses are provided.

7.5.  KPMG Learning Academy shall provide tutors to deliver training courses as it deems fit and KPMG Learning Academy shall be entitled to substitute any tutor with any other person who, in KPMG Learning Academy’s sole discretion, it deems suitable qualified to present the relevant training.

7.6.  Attendance is mandatory for all scheduled lectures. Attendance is recorded during each session by the assigned tutor and forms part of the official course records. It is the responsibility of each student to ensure their presence is accurately registered during the lecture.

7.7.  The students’ personal possessions are their sole responsibility and KPMG Learning Academy accepts no responsibility for anything lost from the training venue.

 

8.      Online Access and Technical Requirements

8.1.  Upon receipt of a confirmation email you will be notified when you have Access to the online course purchased and for the length of time such access will be made available to you.

8.2.  The receipt of an online course is personal to you and you may not transfer your rights to access such course to any other person.

8.3.  It is the student’s responsibility to check that the computer they plan to use to access their live course delivery and study materials is compatible with the minimum specifications requirements as specified in My Kaplan.

9.      ACCA Examinations and Results

9.1.  Students should apply for OnDemand exams through a Computer Based Exam Centre. Students applying for the rest of the ACCA modules which must be sat for within the 4 yearly exam sittings (March, June, September and December) must register through MyACCA.

9.2.  The ACCA Result service is the mechanism of gathering student data to allow for the analysis of pass rates. In turn, students’ details will be shared with ACCA in order to gather quarterly pass rates information through the ACCA Results Service. Students who do not wish to participate may opt out by responding to the opt-out notification email within two (2) business days of receipt. This notification is sent prior to the ACCA exam deadline.

9.3.  ACCA Exam results are issued by ACCA 6 weeks following the respective exam sitting. ACCA undertake many checks and controls during the marking process to ensure that all exam results are accurate. Nonetheless, students may request an administrative review from ACCA whereby they ensure that all stages of the marking and results release process have been strictly followed. 10. Warranties

10.1.  KPMG Learning Academy will provide the study materials in accordance with the course description which is set out on the website.

10.2.  KPMG Learning Academy expect students to verify that the course and study materials in question will meet their needs.

10.3.  KPMG Learning Academy does not guarantee that the study materials will be error free.
KPMG Learning Academy does not make any commitment that the online courses will be compatible with a student’s software or hardware.

11. Complaints and Dispute Resolution

11.1.    If you are not satisfied with the way you have been treated you may explain the problems to the member of staff with whom you are dealing. KPMG Learning Academy will treat all complaints confidentially.

11.2.    Support staff will direct you to the appropriate person who can deal with your complaint. If your complaint is not resolved informally and you wish to make a formal complaint you should ask to speak to the Director of Studies. 

11.3.    Complaints may be done by letter, telephone, email or in person. All complaints at this level will be dealt with within five working days.

11.4.    The Complaints and Appeals procedure is further delved into with KPMG Learning Academy’s Quality Assurance Handbook (Section 7) which can be accessed from the following link: Quality Assurance Handbook. 
If you feel that the Complaints and Appeals procedure has not fully addressed your concerns and you have already gone through KPMG Learning Academy’s complaint process, you may escalate the matter to ACCA at complaints@accaglobal.com. 

11.5.    If you have exhausted both KPMG Learning Academy’s complaint process and ACCA’s, you may proceed to the next step and escalate your complaint to the appropriate regulator, details of which can be found on the ACCA website at the following link:  https://www.accaglobal.com/gb/en/footer-toolbar/contact-us/unhappy.html.

11.6.    Compliments are also welcome as they help us know what we are doing well. So even if you have no complaint, we would still like to hear your feedback and comments.

12. Data Sharing

By agreeing to these terms and conditions, you give your consent to KPMG Learning Academy to share information collected from this agreement with the Malta Further and Higher Education Authority (MFHEA), in line with Cap 607 of the Laws of Malta and GDPR (EU Regulation 2016/679), when required by law.

13. Force Majeure

Neither the student nor the institution shall be liable for failure to meet obligations if caused by events beyond reasonable control (e.g., natural disasters, pandemics, regulatory changes). Notification must be made as soon as practical.
