These Terms and Conditions apply to the sale of any course. Please read these Terms and Conditions carefully before purchasing a course.
1. Ordering Procedures
- In order to purchase a course via the website you must register for an online KPMG Learning Academy account via the website.
- In exceptional circumstances, registration for courses may be made by sending requests through email. In this case, registration for an online KPMG Learning Academy account may not be required, however any course material that is uploaded on the Learning Management System (LMS) will not be accessible without an active KPMG Learning Academy account.
- When you place an order for a course you are agreeing to purchase that course on these Terms and Conditions. KPMG Learning Academy reserves the right to decline or cancel your order, or any part of your order.
- Following receipt by KPMG Learning Academy of your order for a course you will receive an email confirming that your order has been received.
- While every effort will be made for advertised courses to be held as planned, KPMG Learning Academy reserves the right to withdraw at any time courses advertised for sale on the website or brochure.
2. Payment Terms
- The Fee for any course at any given time will be displayed on the website. Fees are quoted in Euros, exclusive of VAT and exclusive of any additional charges, where applicable.
- KPMG Learning Academy may issue notices with respect to discounts when applying for courses. The notice will include a deadline of applications and any cancellations will be dealt with according to Clause 3: Cancellation Rights.
3. Cancellation Rights
- CPE Courses
- You may cancel your purchase of a course within two calendar weeks from date of purchase, or five (5) business days from the course start date, whichever is the earlier.
- You must inform KPMG Learning Academy of your decision to cancel by emailing KPMG Learning Academy on kla@kpmg.com.mt.
- If you cancel your course, you must return any materials you have received from KPMG Learning Academy without undue delay and not later than 1 day after you inform KPMG Learning Academy of the cancellation.
- KPMG Learning Academy reserves the right to withhold the issuance of a credit note in relation to that course as stipulated in the bullet point below, until the training materials have been returned in perfect condition.
- On cancellation, you will be entitled to a credit note on your account if such a cancellation is done within the cancellation period. If a cancellation of booking is received after the timings stipulated above, no credit notes will be issued by KPMG Learning Academy.
- Your order of a course can be transferred to another individual provided that KPMG Learning Academy is advised at least two (2) business days prior to the commencement date of the Course initially registered for. KPMG Learning Academy may, at its sole discretion, accept any such request received after such date.
- When courses are purchased as a bundle and at discounted rates, no credit notes shall be issued should an individual cancel one of the sessions within the bundle. In such cases, one may transfer their booking to another individual for the same course within the same bundle of courses.
- KPMG Learning Academy reserves the right, at any time and for any reason, to cancel or re-schedule the date and time allocated for any course. In the event that a course is cancelled, or an attendee will not be able to attend the said course on the rescheduled date, the individual will be reimbursed the fee paid for the cancelled or rescheduled course and there will be no further liability upon KPMG Learning Academy.
- KPMG Learning Academy reserves the right, in limited instances, to change the format of delivery of the training whilst ensuring that the training material is in line with the originally planned agreement.
- Industry Certifications
- You may cancel your purchase of a course within two calendar weeks from date of purchase, or ten (10) business days from the course start date, whichever is the earlier.
- You must inform KPMG Learning Academy of your decision to cancel by emailing KPMG Learning Academy on kla@kpmg.com.mt.
- If you cancel your course, you must return any materials you have received from KPMG Learning Academy without undue delay and not later than five (5) business days after you inform KPMG Learning Academy of the cancellation.

- You may cancel your purchase of a course within two calendar weeks from date of purchase, or five (5) business days from the course start date, whichever is the earlier.

- If you cancel your course you must return any materials you have received from KPMG Learning Academy without undue delay and not later than two (2) business days after you inform KPMG Learning Academy of the cancellation.
- KPMG Learning Academy reserves the right to withhold the issuance of a credit note in relation to that course as stipulated in the bullet point below, until the training materials have been returned in perfect condition.

- In cases of unplanned absences due to health reasons, participants must inform KPMG Learning Academy on kla@kpmg.com.mt by not later than 08:00am of the event’s date in order to be entitled to a credit note of the fee paid towards the respective course.
- When courses are purchased as a bundle and at discounted rates, no credit notes shall be issued should an individual cancel one of the sessions within the bundle. In such cases, one may transfer their booking to another individual for the same course within the same bundle of courses.
- KPMG Learning Academy reserves the right, at any time and for any reason, to cancel or re-schedule the date and time allocated for any course. 4. Course Materials
- Any supporting material, references, and further reading material will be provided to you in electronic format. The delivery of training and ancillary material will be in the English language.
- Course materials and communications regarding the course are sent by internet e-mail (including attachments to such e-mail). You recognise and accept all risks associated with this method of communication including (but without limitation) lack of security, unreliability of delivery and possible loss of confidentiality and privilege. KPMG Learning Academy will accept no responsibility or liability in respect of risks associated with the use of internet e-mail.
- Any handouts, case studies, supporting material, references and further reading material made available pursuant to the Course will be prepared solely in connection with and for use during the Course. They should not be distributed, quoted, or referred to, in whole or in part, without our prior written consent. Our consent for the whole or part of these documents to be copied or disclosed to any third party or otherwise quoted or referred to, in whole or in part, is on the basis that we do not owe such third parties any duty of care as a result of giving such consent.
- The information contained in the training material will be of a general nature and is not intended to address the circumstances of any particular individual or entity. Although we endeavour to provide accurate and timely information, there can be no guarantee that such information is accurate as of the date it is received or that it will continue to be accurate in the future. No one should act on such information without appropriate professional advice and a thorough examination of the particular situation.
- KPMG Learning Academy does not purport to provide legal advice in the provision of the training services. There shall be no assurance or guarantee that any views that we will express, orally or in writing, will necessarily accord with those of any regulator. The training will be based on laws or regulations current at the date it is provided and should not be relied on subsequent to any change in laws or regulations after that date.
5. Online Sessions
- Online training sessions will be delivered using conferencing services which are required for the purposes of our work. Furthermore, you recognize and accept all risks associated with using this service for such communication, including (but without limitation) lack of security, unreliable and possible loss of confidentiality and privilege, and any consequent unauthorized use. KPMG Learning Academy will accept no responsibility or liability in respect of any such risks.
- Online training Sessions may be recorded for future playback, which may include recording of voice audio and/or web camera video. The attendee’s name may be recorded as part of the video recording. Recordings of sessions are used for internal training and monitoring purposes and will not be distributed, in whole or in part, to the attendees and/or external parties outside KPMG Learning Academy and the KPMG member firms.
6. Data Privacy
- Data Protection Legislation (“DP Legislation”) means, the Data Protection Act, Chap 586 and the General Data Protection Regulation (EU 2016/679) and any legislation which amends, re-enacts or replaces it in Malta. The definitions and interpretations in the DP Legislation apply to this clause. This clause applies to personal data provided to us by you or on your behalf in connection with the Services (“Personal Data”).
- You warrant and represent that you have any necessary consent, provided any necessary notice and done all other things required under the DP Legislation to disclose Personal Data to us in connection with the service provided. We shall act as a Controller and perform services in accordance with the DP Legislation.
- We will take appropriate technical and organisational steps to protect against unauthorised or unlawful processing of Personal Data and accidental loss or destruction of, or damage to, Personal Data. We shall process the Personal Data as reasonably required (i) to provide the Services; (ii) for our reasonable business purposes including facilitation and support of our business and quality control; and (iii) to meet our legal and regulatory obligations. We may share Personal Data with Other KPMG Persons or other parties who facilitate or support our business. We will only make such a disclosure where it is required in connection with such purposes and in compliance with applicable DP Legislation. We shall notify you promptly: (i) upon receiving a request for Personal Data or other request from a data subject, or if we receive any claim, complaint or allegation relating to the processing of the Personal Data; (ii) upon becoming aware of any breach of security leading to the destruction, loss or unlawful disclosure of the Personal Data in KPMG’s possession or control. Upon request, each Party shall provide the other with information relating to its processing of Personal Data as reasonably required for the other to satisfy its obligations under DP Legislation.
7. Certificates of Attendance
- Certificates of attendance are issued following the completion of the course and subject to at least 75% attendance of the course. Hours will, however, be deducted to reflect the actual attendance time for those who attend less than 100% of the course
- You assume responsibility for retention, management and disposal of the documentation that is produced, prepared, acquired or brought into being, whether in hard copy or intangible form, and which is deemed to belong to yourselves, in terms of and in compliance with relevant laws and regulation or as required by specific professional standards as applicable.
8. Force Majeure
- In the event of any cause beyond KPMG Learning Academy’s or the individual’s reasonable control and in the event of any such occurrence affecting either party, one shall be obliged as soon as reasonably practicable to notify the other, who shall have the option of suspending or terminating the respective service on notice taking effect immediately on delivery.
9. Complaints
- If you are not satisfied with the way you have been treated, you may explain the problems to the member of staff with whom you are dealing.
- Support staff will direct you to the appropriate person who can deal with your complaint. If your complaint is not resolved informally and you wish to make a formal complaint you should ask to speak to the Head of KPMG Learning Academy.
- Complaints may be done by letter, telephone, email or in person. All complaints at this level will be dealt with within five working days.
- Compliments are also welcome as they help us to understand what we are doing well. So even if you have no complaint, we would still like to hear your feedback and comments.
