Course Description:

This session will delve into the practical aspects of the application of the Arm’s Length Principle under the upcoming Maltese transfer pricing regime, giving a snapshot on the applicability of the rules as well as an overview of what might be expected by the Maltese tax authorities in terms of transfer pricing study, documentation & compliance process. The session would also highlight the practical issues commonly noticed during transfer pricing audits and assessments as well as the key points for businesses to manage them.

Target Audience:

This session is relevant to CCFOs, Tax Directors, CSPs, Accountant and Lawyers.

Prerequisites:

A basic understanding of tax and accounting concepts are useful.

Reading Material:

  • The latest version of the OECD TP 2022 Guidelines will be included as references (available for free reading online on the OECD website).
  • Prior required reading for each session: slide pack for and OECD TP Guidelines relevant to the session.
  • Additional reference material would be suggested during each session

Since joining KPMG in 2002, Juanita has worked in corporate taxation, providing advice to multinationals seeking assistance in tax matters and related planning. Her work covers both international and domestic tax issues, extending to direct and indirect taxation. She has advised a wide variety of multinationals especially in financial services industry, namely, asset managers, banks, and insurance underwriters. Juanita has also delivered restructuring advice to gaming clients. She leads the Tax Committee at the Institute of Financial Services Practitioners, providing feedback on proposed legislation, including on cryptocurrencies and ICOs, to government authorities. In addition she has assisted clients with effective global tax solutioning, including mergers and acquisitions and advised on access to tax treaties, foreign tax credits, financing and efficient repatriation. She leads the automatic exchange of information service line. Juanita is particularly interested in the EU’s impact on tax matters and has acted as advisor to the Government on various tax-related EU law issues. Juanita regularly delivers presentations on topical tax issues at both local and international fora and has published articles in various international tax journals and reviews. Juanita is a highly-respected specialist in her field, is a member of the International Fiscal Association, and is recognised by Expert Guides and ranked as a Band 1 practitioner of note by Chambers and Partners, where she is highly rated for her “expertise and drive“, and as one who “advises a raft of impressive clients on both direct and indirect taxation mandates. Beate Orlova

Beate is an experienced tax professional with specialization in international corporate tax. She also has practical experience and in-depth knowledge in transfer pricing, M&A and due diligence projects. Beate joined KPMG in 2021 and is currently a candidate for a Master’s degree in Finance at the University of Aberdeen. She also holds a Bachelor’s degree from Maastricht University. Following a specialization in transfer pricing, Beate shifted her focus to other international cross-border transactions, and was involved in various structuring, reorganization and due diligence projects, as well as tax risk management. Beate has also presented in several tax seminars in English, Russian and Latvian languages, and she also continues to regularly publish written articles on the current tax topics. Over the years, Beate has enjoyed a very diverse client portfolio and has consulted clients from various industries, including tourism, pharmaceutical, financial, manufacturing and other industries. As a personal interest, Beate closely follows various climate initiatives and actions, with particular interest in sustainable finance.
